Notice Requiring the Preparation and Implementation of Pollution Prevention Plans in respect to Specified Toxic Substances Released from Base Metals Smelters and Refineries and Zinc Plants

The following forms must be used to submit information for the Notice Requiring the Preparation and Implementation of Pollution Prevention Plans in Respect of Specified Toxic Substances Released from Base Metals Smelters and Refineries and Zinc Plants that was published in Part I of the Canada Gazette on April 29, 2006.

Schedule 1: Declaration That a Pollution Prevention Plan Has Been Prepared and Is Being Implemented (Subsection 58(1) of CEPA 1999)

Schedule 1 is also referred to as the Declaration of Preparation.

This form must be used to declare that a pollution prevention plan has been prepared and is being implemented for the Notice Requiring the Preparation and Implementation of Pollution Prevention Plans in Respect of Specified Toxic Substances Released From Base Metals Smelters and Refineries and Zinc Plants. This form must be submitted within 30 days after the end of the period provided to prepare and begin implementing the pollution prevention plan as specified in the Notice.

Schedule 2: Request for Waiver of the Requirement to Consider a Factor or Factors

This form must be used to request a waiver of the requirement to consider a factor or factors specified in the Notice Requiring the Preparation and Implementation of Pollution Prevention Plans in Respect of Specified Toxic Substances Released From Base Metals Smelters and Refineries and Zinc Plants.

Schedule 4: Interim Progress Report

This form must be used by persons subject to the Notice Requiring the Preparation and Implementation of Pollution Prevention Plans in Respect of Specified Toxic Substances Released From Base Metals Smelters and Refineries and Zinc Plants to report to the Minister about the progress made in implementing their pollution prevention plan.

Schedule 5: Declaration That a Pollution Prevention Plan Has Been Implemented (Subsection 58(2) of CEPA 1999)

Schedule 5 is also referred to as the Declaration of Implementation.

This form must be used to declare that the implementation of the pollution prevention plan has been completed for the Notice Requiring the Preparation and Implementation of Pollution Prevention Plans in Respect of Specified Toxic Substances Released From Base Metals Smelters and Refineries and Zinc Plants. This form must be submitted within 30 days after the end of the period provided to implement the pollution prevention plan as specified in the Notice.

Status Report Form on Conformance with the Environmental Code of Practice for Base Metals smelters and Refineries

This form must be used to report on the status of the conformance with the Environmental code of Practice for Base Metals Smelters and Refineries in Section 8.1 of Schedules 1, 4 and 5 of the Notice Requiring the Preparation and Implementation of Pollution Prevention Plans in Respect of Specified Toxic Substances Released From Base Metals Smelters and Refineries and Zinc Plants, published in the Canada Gazette, Part I on April 29, 2006.
