Name of accused: TONY HAYWARD SALES INC. d.b.a HAYWARD COMPONENT INDUSTRIES
Alleged violation of which the accused is charged: Offer for sale and sale of a product containing a hydrochlorofluorocarbon (HCFC) in a pressurized container, contrary to subparagraph 23(2)of the Ozone-depleting Substances Regulations, 1998 (ODSR 1998) (18 counts) and the unlawful import of a product, contrary to paragraph 23(1) in contravention of ODSR 1998 (7 counts).

Expiry of the EPAM: October 31, 2008 or when the terms and conditions have been fulfilled to the satisfaction of the Attorney General of Canada or otherwise in accordance with the applicable provisions of CEPA 1999.
Summary of measures required to be completed by the accused under the EPAM:
- Develop and deliver a training program for its clientele, relating to environmental issues associated with the import and sale of ozone depleting substances (ODS). A copy of the course outline will be submitted to Environment Canada for approval of the Regional Director, Environment Enforcement, within 30 days of execution of this Agreement. The training will be completed within twelve months of such approval.
- Provide a report to Environment Canada following each of the training sessions conducted. The report shall consist of the location of the training and a list of the people in attendance.
- Payment of $5,000.00 to the Receiver General of Canada in trust for the Environmental Damages Fund, as administered by the Regional Director General, Environment Canada, Ontario Region. These funds shall be made available for work that will benefit the environment.
If there is any variance between the texts of the EPAM as displayed in the CEPA Environmental Registry and the text of the document registered on November 08, 2007 at the Ontario Provincial Court in Oshawa , Ontario , the court-registered text takes precedence.
