Proposed amendments to the Contraventions Regulations: invitation to comment

Proposal to designate, as ticketable offences under the Contraventions Act and the Contraventions Regulations, various offences under regulations of the Canadian Environmental Protection Act, 1999 (CEPA 1999). 

As indicated in the CEPA 1999 Compliance and Enforcement Policy, tickets are available as an enforcement measure for minor regulatory offences which have minimal or no threat to the environment or human life or health. Using tickets provides an overall less costly and less time-consuming alternative to summary convictions, to deal with individuals or companies that violate CEPA 1999 regulations and who commit, for example, the offence of:

  • failing to sign a report required to be submitted to the Minister of Environment under a given CEPA 1999 regulations;
  • failing to file a complete report (that is, one containing all the information required by the regulations);
  • failing to keep all records, reports and other prescribed documents at the facility for a period of five years;
  • etc.

The Contraventions Act allows an alleged violator to enter a plea and make representations or contest the fines associated with the offence before the court.  Please refer to the Department of Justice Website  to consult the Act.
