Alleged violation of which the accused is charged: Illegally imported and sold streamers in aerosol which contained a propellant composed mainly of CFC-11 and CFC-12, therefore contravening to the paragraphs 18(1) and 19a) of the Ozone-depleting Substances Regulations (1998) DORS/99-7 and its modification DORS/2001-2.

Summary of measures required to be completed by the accused under the EPAM:
- The implementation of an operational procedure and management policy specific to the company with respect to the prohibition of the manufacture, importation and sale of products containing CFCs;
- In accordance with CEPA 1999, the destruction of the pressurized containers, if they are still in the possession of the Company, within three months of the signing of the Agreement and submit an affidavit attesting to the destruction to the Attorney General of Canada;
- The writing and publication of an article in an information bulletin of the Canadian Importers and Exporters Association;
- The payment of a total of $100,000 to be deposited into the Environmental Damages Fund for damages caused to the environment.
If there is any variance between the text of the EPAM as displayed in the CEPA Environmental Registry and the text of the document submitted to the Cour du Québec in Montréal, the court-registered text takes precedence.
