Key considerations with respect to the export, import or transit of hazardous wastes or hazardous recyclable material

You will find below key considerations with respect to the export, import or transit of hazardous wastes or hazardous recyclable material.

Contract and Insurances

  • Have a signed written contract between the generator and receiver of the hazardous waste or hazardous recyclable material as required under the Export and Import of Hazardous Waste and Hazardous Recyclable Material Regulations (EIHWHRMR) (exports and imports only).
  • Ensure that all carriers are authorized carriers and that the recycling or disposal facility is certified to accept your specific hazardous waste(s) or hazardous recyclable material(s).
  • Ensure that the Canadian importer or Canadian exporter (as the case may be) and all carriers have valid insurance coverage as required under the EIHWHRMR.

Notification of import, export or transit

  • Complete an Administrative Notice Form as required by the EIHWHRMR.
  • Obtain a Permit issued by the Minister of the Environment for the export, import or transit of hazardous waste or hazardous recyclable material before proceeding with any shipments between the valid dates set out in the Permit.

Movement

  • Ensure that the quantity in the shipment does not exceed the quantity provided and approved in the Permit.
  • Ensure that the Movement Document is correctly completed, signed and accompanies each approved shipment of hazardous waste or hazardous recyclable material entering or exiting Canada.
  • Comply with all requirements of the Transportation of Dangerous Goods Regulations during the movement of the hazardous waste(s) or hazardous recyclable material(s), where applicable.
  • Ensure that a copy of the Movement Document and a copy of the Permit are provided to the carrier(s) and that both are dropped off at the port of entry/exit to a Canadian Border Services Agency agent.

Post-movement

  • Submit copies of the completed Movement Document and Certificate of recycling/disposal to Environment Canada (EC) to fulfill your obligations under the EIHWHRMR.
  • Retain a copy of the Movement Document at your place of business in Canada for three years following the completion of the movement.
