The Environmental Damages Fund factsheets below are designed to provide information at a glance about the fund, relevant legislation, program criteria and eligibility. In addition, each factsheet includes two examples of regionally funded projects.


The Environmental Damages Fund (EDF) follows the Polluter Pays Principle to help ensure that those who cause damage to the environment take responsibility for their actions.

Created by the Government of Canada in 1995, the EDF is a specified purpose account, administered by Environment Canada to provide a mechanism for directing funds received as a result of fines, court orders and voluntary payments to priority projects that will benefit our natural environment. A specified purpose account is one maintained separately from the general revenues of the Government of Canada.

How Funds Are Directed

The majority of funds are directed to the EDF through statutory fines and court-ordered payments. A number of federal statutes authorize discretionary court orders that have been used to direct monies to the EDF, for example:

  • Canada Shipping Act, 2001
  • Canadian Environmental Protection Act, 1999
  • Fisheries Act
  • Species at Risk Act

All fines collected under the Migratory Birds Convention Act, 1994 must be directed to the EDF, by virtue of subsection 13(6) of the Act.

How Projects Are Funded

Environment Canada solicits project proposals from eligible groups and ensures projects are carried out in a cost-effective, technically feasible and scientifically sound manner.

Monetary awards are used to fund projects that focus on environmental restoration and improvement, research and development, and education and awareness related to environmental restoration and compliance with regulations. All projects must meet EDF program criteria.

Funds are disbursed in the geographic region (local area, region, province or territory) where the incident occurred. Priority is given to restoration projects that address the damage caused by the original incident.

Improvements to the EDF program ensure that funds are disbursed promptly to recipients capable of delivering projects with strong environmental results.

Since 1995, the EDF has received over $4.5 million from 154 awards and has funded 149 projects across Canada.

Rehabilitation Project to Construct Nesting Shelters

Ducks Unlimited Canada received $14,565 to install nesting shelters to improve feeding and breeding rates of the eider bird population on islands located in Main Brook and Roddickton, Newfoundland and Labrador, and to hold education sessions to rebuild stewardship capacity among local youth. Project funded with fines imposed as the result of a violation of the Migratory Birds Convention Act, 1994.

Research Project to Monitor Seabird Populations for Oil Spill Preparedness

The Grand Manan Whale and Seabird Research Station received $25,000 to identify and map the feeding distributions of shearwaters and gulls in the Bay of Fundy, Nova Scotia, to improve planning, training and response to oil spills. Project funded with fines imposed as the result of a violation of the Canada Shipping Act, 2001, s. 193.

Restoration and Awareness Project

The Conseil régional de l'environnement de l'Abitibi-Témiscamingue [Abitibi-Témiscamingue regional environment council] was granted $200,000 for bank revegetation and to raise public awareness to prevent the degradation of watercourses in the Témiscamingue MRC territory. Project funded with fines imposed as the result of a violation of the Fisheries Act.

Restoration Project

The Société d'aide au développement des collectivités du Témiscamingue [Society to promote collectivity development in the Témiscamingue region] was granted $110,000 to ensure the free movement of fish and reduce sediment input in yellow walleye spawning grounds in lakes and rivers of the Kipawa controlled harvesting zone in Témiscamingue. Project funded with fines imposed as the result of a violation of the Fisheries Act.

Restoration Project to Improve Water Quality

The Couchiching Conservancy received $20,000 to improve water quality in Simcoe County by installing 1500 metres of cattle exclusion fencing, and planting 500 trees and shrubs to reduce erosion and provide habitat for sensitive grassland species. Project funded with fines imposed as the result of a violation of the Canadian Environmental Protection Act, 1999.

Rehabilitation Project

The Niagara River Restoration Council received $13,135 to remove three major barriers to fish migration and to rehabilitate 300 metres of habitat to stabilize stream banks and improve water quality in the Niagara River watershed. Project funded with fines imposed as the result of a violation of subsection 38(4) of the Fisheries Act, R.S.C. 1985.

Research and Development Project to Monitor Contaminants in Arctic Landfills

The University of British Columbia received $75,000 to study the long-term and cumulative effects of contaminants in soils, surface water and groundwater in Arctic landfills, to protect fish habitat from deleterious substances identified in the Northwest Territories and Nunavut. Project funded with fines imposed as the result of a violation of subsection 36(3) of the Fisheries Act.

Project to Solve Illegal Hunting Cases

SASKTIP inc. received $10,000 to develop promotional materials to generate information from the public that might help apprehend and convict individuals involved in illegal hunting activities in northern Saskatchewan. Conducted jointly with Saskatchewan Environment, the United States Fish and Wildlife Service, and Environment Canada. Project funded with fines imposed as the result of a violation of the Migratory Birds Convention Act, 1994.

Restoration and Education Project to Improve Water Quality

The North Shore Stream Keepers received $15,068 to develop a multi-site water quality monitoring program to restore local watersheds along MacKay Creek and to hold education sessions to encourage action by local residents. Project funded with fines imposed as the result of a violation of the Fisheries Act, R.S.C. 1985.

Restoration and Habitat Recovery of Burrard Inlet

The Pacific Wildlife Foundation received $48,680 to restore historic Burrard Inlet eelgrass beds to recover dependent fish and bird populations. Project funded with fines imposed as the result of a violation of the Fisheries Act, R.S.C. 1985.
