Import And Sale Of Controlled Substance Results In A Court Directed Fine And Training Program For An Ontario Company

OSHAWA, Ontario -- Tony Hayward Sales Inc., doing business as Hayward Component Industries of Ajax, Ontario, accepted responsibility in the Ontario Court of Justice for seven (7) counts of importing a controlled substance and eighteen (18) counts of offering for sale a controlled substance.  This was in contravention of the Ozone-Depleting Substances Regulations, 1998 made pursuant to the Canadian Environmental Protection Act, 1999(CEPA 99).

Tony Hayward Sales Inc. entered into an Environmental Protection Alternative Measures (EPAM) agreement with the Attorney General of Canada subject to S..295 of (CEPA 99).  As a result of this agreement Tony Hayward Sales Inc.  developed and delivered a training program related to environmental issues associated with the import and sale of ozone-depleting substances (ODS). A copy of the course outline was supplied to the Regional Director, Environment Enforcement Directorate, Environment Canada for his approval.  As specified in the EPAM, the training was completed within 12 months of the approval and Environment Canada was provided with a report outlining of the location of the training and listing the attendees following each of the sessions conducted. As part of the alternative measures, a payment of $5,000 was also made to the Environmental Damages Fund.
