G.H. Factory Sales Ltd. Sentenced To Pay a $3,500 Penalty for One Violation of the Vehicle, Engine and Equipment Emissions Provisions of the Canadian Environmental Protection Act, 1999.

Halifax, Nova Scotia - G.H. Factory Sales Ltd. pleaded guilty in Nova Scotia Provincial Court in Halifax on October 21, 2009 for violating one section of the Vehicle, Engine and Equipment Emissions Provisions of the Canadian Environmental Protection Act, 1999.

Charges were laid on September 17, 2009 after an investigation by Environment Canada. 

The charges stemmed from the company’s importation of 570 chainsaws, generators and engines without maintaining and presenting records in relation to the design, manufacture, testing and field performance of their engines. These records are necessary in order for Environment Canada to determine whether the engines meet federal air emission standards.

The court ordered penalty is $3,500, and G.H. Factory Sales Ltd. must also forfeit the non-compliant engines to Environment Canada for destruction at their own expense.

Environment Canada was advised of the importation of the chainsaws, generators and other engines by the Canada Border Services Agency.  During an inspection, it was discovered that there were no emission labels on a number of chainsaws, generators and engines.  The chainsaws, generators and engines were subsequently seized and then removed by Environment Canada for safekeeping.
